LIMITATIONS OF THE RULE OF LAW
- Ignorance
- poverty
- overcrowding of the courts
- Immunity clause for certain individuals in public offices
- delegated legislation
- administrative tribunal
- institution of special courts
- During “a state of emergency”
SOLUTIONS TO THE LIMITATIONS OF THE RULE OF LAW
- it helps in resolving conflicts
- it restricts people from behaving in an untoward manner
- It deters people from behaving in a manner that affects other people negatively
- it leads to the following due process
- it leads to a respect for the system and the leaders of the system
- it prevents any form of dictatorship as everyone answers to it
- It ensures that the principles of law and justice are adhered to by everyone which brings about fairness and equality of all before the law
